\n\tIn their bid to hunt a brand new trial or resentencing,\u00a0Lyle and\u00a0Erik Menendez<\/a>\u00a0have filed\u00a0a blistering movement to disqualify the workplace of the District Attorney from taking part within the proceedings.<\/p>\n \n\t\u201cThe record shows a conflict that renders it unlikely Erik and Lyle can receive a fair resentencing hearing, recusal is proper,\u201d the 160-page submitting states.<\/p>\n \n\tThe case involving the famed brothers \u2014 who\u00a0have served 35 years in jail for the 1989 murders of their dad and mom, Jose and Kitty, at their Beverly Hills dwelling \u2014 has featured numerous twists and turns over the previous six months.\u00a0In October, then-District Attorney George Gasc\u00f3n moved to cut back the brothers\u2019 sentence from life with out parole to 50 years to life. That discount, if granted, would make the brothers instantly eligible for parole. But Gasc\u00f3n misplaced within the November election, and newly elected D.A. Nathan Hochman reversed course and withdrew Gasc\u00f3n\u2019s resentencing suggestion.<\/p>\n \n\t\u201cThe views of the family as to continued punishment do not align with the views of the new District Attorney,\u201d the movement says. \u201cThey are a full 180-degrees apart.\u201d<\/p>\n \n\tLawyers for the brothers laid out numerous conflicts involving Hochman, who \u201cadmitted that he had already spoken with Kathleen Cady, the lawyer representing Milton Andersen, the only family member to oppose resentencing. Less then two weeks later, it was Ms. Cady who Mr. Hochman selected to be the new head of the Department of Victim Services,\u201d the movement states.<\/p>\n \n\t\u201cThe D.A.\u2019s shenanigans in this case are next level gaslighting,\u201d says Mark Geragos, an lawyer for the brothers, tells Variety<\/em>.<\/p>\n \n\tThe submitting slams the D.A. for not executing the desires of the Menendez household.<\/p>\n \n\t\u201cNo-one from the District Attorney\u2019s victim services department has contacted even a single one of the family members whose views conflicted with the views of Ms. Cady\u2019s former client,\u201d the movement continued. \u201cThese family members shared their consistent view that nearly 35 years in prison was enough and Erik and Lyle should indeed be resentenced.\u201d<\/p>\n
